New registration requirement for short-term rentals in Spain

Retrieved from 2 January 2025 a new registration requirement for short-term rentals will enter into force in Spain. A transition period is foreseen until 1 July 2025 allowing time for the government, digital platforms and landlords to adapt.

A registration requirement will apply to owners who rent out furnished residential properties through short-term contracts. Here is everything you need to know about these new regulations.

Which leases are subject to the registration requirement?

The registration requirement applies if you want to rent out your property on a short-term basis and advertise it online. Short-term basis means residential furnished rental for non-permanent occupation.

  • Seasonal rental, for example, for workers or students temporarily staying in a region.
  • Holiday rental, such as holiday homes and flats for tourists.

Important: each accommodation must be individually registered. For example, if you rent out several rooms separately in one property, you should separate registration for each room request.

Hotels and campsites are not targeted.

Rental of boats or ships, for example, should also be registered, but this article will be limited to real estate.

In which regions does this obligation apply?

These regulations apply national and is in force throughout Spain, regardless of the autonomous region.

How do I register my property?

To register your property, complete the following steps:

  1. You register your property via the digital counter: Ventanilla Única Digital de Arrendamientos (online platform of the property register). You will need your Spanish digital signature (certificado digital or cl@ve) needed.
  2. You will share the following information per accommodation unit: address, property registration code ( Código Registral Único), the cadastral reference, type of accommodation, type of property (your own home, a second residence or other type), type of rental (holiday or seasonal rental), maximum number of occupants, the rental licence of the autonomous region, the consent of the co-owners' association, the category of rental for tourism purposes and/or category of non-tourism purposes.
  3. If you are a natural person, you will share the following information: your full name, your DNI or NIE number, your address, your phone number and your e-mail address.
    If you rent through a company, share: the company name, the company number, the name of the director, the registered office, a telephone number and an e-mail address.
  4. After entering these details, you will immediately and automatically receive a registration number for each type of rental. You may therefore receive a registration number for tourist rentals and a number for non-tourist rentals.
  5. If incorrect information is uploaded, the award may be denied, after which you can appeal.
  6. Finally, your application will be checked and assessed. In case of a positive assessment, the registration number will be entered in the property register. In case of a negative assessment, you will have seven days to amend the application. If the application still receives a negative assessment after that, the provisional number will be invalidated.
  7. Every 12 months, you need to submit a new application.

When can I advertise on online platforms?

You should pass on the registration number to the online platforms through which you rent out the property. Online platforms are required to conduct random checks on a regular basis.

Are there any other commitments?

For seasonal rentals, you should also consider the obligation of the registration of rental deposit.

In addition, you will also be required to request personal information from your guests/tourists and pass it on to the police via the SES.HOSPEDAJES platform. These are the so-called '42-data data' that you need to request and transmit. You will also need the Spanish digital signature for this.
